GEORGE TOWN: A company director has been fined RM20,000 by a magistrate’s court here over the fatal toppling tower crane incident.
He admitted failing to provide a safety system for the foundation construction of the tower crane that crashed and caused the death of a man.
Ujung Pelangi Sdn Bhd director Chan Tuck Hei pleaded guilty to the offence. Liang Yit Kwang, 65, died after the tower crane toppled onto three pre-war houses at the Sri Bahari and Transfer Road junction on Oct 4 last year.
Chan was charged under Section 17(1) of the Occupational Safety and Health Act 1994 which is punishable under Section 19 of the same Act.
Those convicted under this section could be fined up to RM50,000 or jailed for a term not exceeding two years or both.
Chan was represented by Su Tiam Leong while prosecuting officer Mazlyne Mat Akat represented the Penang Department of Occupational Safety and Health (DOSH).
Magistrate Sri Pracha Nanthini fined Chan RM20,000 in default of six months’ jail.
It was reported that the crane erected on the construction site of a planned 20-storey hotel in Transfer Road toppled onto the houses across the junction.
Liang, who was believed to be asleep on the second floor of one of the houses, was killed.
